These Terms of Use govern your access to and use of www.giftynia.com (the “Site”), operated by GIFTYNIA (“GIFTYNIA”, “we,” “us,” “our”). By browsing, creating an account on, or otherwise using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

1. Accounts
- You may browse the Site without an account, but an account is required to check out, track orders, save addresses, and submit reviews.
- You can create an account with an email and password, or via Google Sign-In.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at giftyniaofficial@gmail.com if you suspect unauthorized access.
- We may suspend or terminate an account that violates these Terms, is used fraudulently, or poses a security risk to the Site or other users.
2. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to the Site, other users’ accounts, or our systems.
- Interfere with or disrupt the Site’s operation (e.g., through scraping at scale, denial-of-service attempts, or introducing malicious code).
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use automated means (bots, scrapers) to place orders or harvest data from the Site without our written permission.
3. User content (reviews)
- Buyers who have an account may submit a written review (up to 200 words) and up to two images for a product.
- License: by submitting a review, you grant GIFTYNIA a non-exclusive, worldwide, royalty-free license to display, reproduce, and use that review (text and images) on the Site and in related marketing, with attribution limited to your name/initials as configured in your account.
- Standards: reviews must be your own genuine opinion and must not contain: false or misleading claims, defamatory or abusive content, content infringing someone else’s copyright or privacy, spam or promotional content unrelated to the product, or content identifying another private individual without consent.
- Moderation: we reserve the right, but not the obligation, to review, hide, or remove any review that violates these standards, at our discretion and without prior notice. This is a lightweight moderation model — reviews are visible by default and may be removed after the fact if flagged, rather than approved before publication.
- Ownership: you retain ownership of your review content, subject to the license granted above.
4. Third-party services and links
The Site integrates with and may link to third-party services, including:
- Razorpay — for payment processing (see Razorpay’s own terms and privacy policy).
- Google — for optional sign-in via Google OAuth.
- Courier/logistics partners — for delivery.
- Ola Maps — for address autocomplete during checkout.
We are not responsible for the content, accuracy, or practices of third-party services. Your use of them is subject to their own terms.
5. Intellectual property
The Site’s design, code, graphics, logos, and content (excluding user-submitted reviews, which remain governed by §3) are owned by or licensed to GIFTYNIA and protected under applicable intellectual property law. You may view and use the Site for personal, non-commercial shopping purposes only; no other use, reproduction, or distribution is permitted without our written consent.
6. Availability and disclaimers
The Site is provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, error-free, or fully secure at all times, and we are not liable for temporary unavailability due to maintenance, technical issues, or circumstances beyond our control. 7. Limitation of liability
To the maximum extent permitted by law, GIFTYNIA is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Site (as distinct from a specific order, which is governed by our Terms & Conditions and Return & Refund Policy).
8. Indemnity
You agree to indemnify and hold GIFTYNIA harmless from any claim or demand arising from your breach of these Terms of Use or your misuse of the Site, including any user content you submit.
9. Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, for conduct that violates these Terms of Use or is otherwise harmful to GIFTYNIA, other users, or third parties.
10. Changes to these Terms of Use
We may update these Terms of Use from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
11. Governing law
These Terms of Use are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts at Habra, India.
