These Terms & Conditions (“Terms”) govern every purchase made on www.giftynia.com (the “Site”), operated by GIFTYNIA, a company incorporated under the Companies Act, 2013, having its registered office at Hijalpukur Main Road, Nagarthuba, Habra, North 24 Parganas, West Bengal - 743263 (“GIFTYNIA”, “we,” “us,” “our”). By placing an order on the Site, you (“you,” “buyer”) agree to be bound by these Terms. Please also read our Terms of Use, Privacy Policy, and Return & Refund Policy, which are incorporated by reference.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to place an order on the Site. If you are under 18, you may use the Site only under the supervision of a parent or legal guardian who agrees to these Terms.
2. Products and listings
- We are a single-seller curated gifting platform — every product listed on the Site is sold directly by GIFTYNIA; we do not host third-party sellers.
- Product images are for illustrative purposes. Because many items are handcrafted or artisanal, minor variation in color, texture, or finish between the image and the delivered product is normal and does not, by itself, constitute a defect.
- We make reasonable efforts to keep product descriptions, pricing, and stock levels accurate, but errors may occur. If we discover a pricing or listing error after you’ve placed an order, we will contact you before processing the order and you may cancel for a full refund if you do not wish to proceed at the corrected price.
- Stock is not guaranteed until your order is confirmed; if an item becomes unavailable after purchase, see §5.
3. Pricing and taxes
- All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise at checkout.
- Shipping fees, gift packaging upgrades, and any applicable convenience fees are shown separately at checkout before you confirm payment.
- We reserve the right to change prices at any time; the price applicable to your order is the price displayed at the time you complete checkout.
4. Order placement and acceptance
Placing an order is an offer to purchase, which we accept when we confirm your order (typically upon successful payment). We may decline or cancel an order at our discretion — for example, in cases of suspected fraud, pricing errors, or stock unavailability — in which case any payment collected will be refunded in full.
You are responsible for providing accurate delivery information (recipient name, address, phone number, pincode). We are not liable for delivery failure caused by incorrect information you provided.
5. Payment
- Payment is processed through Razorpay, a third-party PCI-DSS-compliant payment gateway supporting UPI, cards, net banking, and wallets.
- We do not store your card, UPI, or banking credentials — these are handled directly by Razorpay under its own security standards and privacy practices.
- Your order is confirmed only after Razorpay confirms successful payment via a verified webhook. If payment is deducted but your order is not confirmed, see our Return & Refund Policy §4.
6. Shipping and delivery
- We ship to addresses within India. Estimated delivery timelines are shown at checkout and on the order tracking page; these are estimates, not guarantees, and may be affected by courier delays, weather, or circumstances beyond our control.
- Risk in the goods passes to you upon delivery to the address provided. Please inspect your order upon receipt and report any issue per our Return & Refund Policy within the stated window.
- Gift packaging, wax-seal notes, and similar customization options are fulfilled as configured at checkout; complimentary packaging thresholds and add-on fees shown on the Site at the time of your order apply.

8. Reviews and user content
If you submit a product review, it is governed by the User Content terms in our Terms of Use, including our right to moderate, hide, or remove reviews.
9. Intellectual property
All content on the Site — including the GIFTYNIA name, logo, product photography, descriptions, and site design — is owned by or licensed to GIFTYNIA and protected under Indian copyright and trademark law. You may not reproduce, resell, or repurpose this content without our written consent.
10. Limitation of liability
To the maximum extent permitted by law, GIFTYNIA’s total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including loss of enjoyment of a gift-giving occasion, except where such liability cannot be excluded under applicable consumer protection law.
11. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, courier network disruptions, government action, or internet/payment gateway outages.
12. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to the dispute resolution mechanisms available to consumers under the Consumer Protection Act, 2019 (including approaching the National Consumer Helpline or the relevant Consumer Disputes Redressal Commission), any dispute not resolved informally shall be subject to the exclusive jurisdiction of the courts at Habra, India.
13. Grievance redressal
For any complaint regarding these Terms, contact our Grievance Officer as named in our Privacy Policy §9, or write to giftyniaofficial@gmail.com. We will acknowledge your complaint within 48 hours and aim to resolve it within one month.
14. Changes to these Terms
We may revise these Terms from time to time; continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be highlighted on the Site.
